Understanding the Program

The EB-5 Immigrant Investor Program: What Is It? A U.S. Congressional avenue known as the EB-5 Immigrant Investor Program allows qualified foreign people and their immediate families to get permanent residency in exchange for a qualifying capital commitment to a U.S. business that creates jobs. No sponsorship from the employer. No yearly lottery. Additionally, your status is yours, not your company's, unlike all other employment-based visa categories.
Who Can Apply?
Any foreign national who satisfies the conditions for source of funds and net worth. You, your spouse, and any unmarried children under 21 are all covered by a single application.
The $800,000 Threshold
The majority of EB-5 applicants are eligible for the $800,000 minimum investment criterion since they invest through a TEA or Rural category project. Which choices are appropriate for you will be explained by your InvestMigrate adviser.
No Employer Required
EB-5 employment visas are independent of employers, in contrast to H-1B or EB-3 visas. Your permanent residency is independent; you are free to live wherever in the United States, work as you see fit, or not work at all.
What Do You Receive?

Set-Aside Categories

EB-5 and Green Card Process

EB-5 application (Fro I-526E)
*Adjustment of status app. (From I-485)
Submit Form 1-526E to the Department of Immigration for Green Card Approval

*Optional adjustment of status (3 months). Form 1-485
It allows you to obtain immigration status to reside and work in the US while you wait for your 1-526E Green Card petition to be approved.

Conditional Green Card
1 year and 9 months

Once your 1-526E is approved, you will receive a conditional Green Card.

I-829 Petition
(Removal of Conditions)

1 year and 9 months after receiving your conditional Green Card, your attorney will file and 1-829 petition to remove the conditions so you can obtain a permanent Green Card.

Citizenship
5 years

Three years after becoming a permanent resident, you can apply for U.S. citizenship through naturalization.
